This agreement is entered by and between you and the Traffic Exchange business owner.

It is understood that the Traffic Exchange business owner is the person that actually runs and manages the website, and receives any payments made for the offered memberships, services, goods or any other offers made using the site. The Traffic Exchange business owner is the only responsible party for the management of the traffic exchange service, promotions, incentives and any other benefits that this site offers now and may offer in the future. You enter this agreement with the business owner at the date of Sign Up. In the event that this business owner cancels the service and leaves the website it is possible that a new person may become the business owner. The new business owner's responsibility begins at the date of his taking over the site, and he may not be held responsible for previous offers, agreements or any other previous events or matters. The new business owner is free to make any changes that he deems necessary or convenient.

The domain owner, server owner, web hosting company, script owner, script usage service provider or any other third party is not to be considered the Traffic Exchange business owner and therefore will not be held liable for any matter or subject of any responsibility regarding the Traffic Exchange service and the offers or agreements made by the business owner.

For the following Terms, the word we will be understood as the business owner and any persons that may assist him or her in the management of this website.

By joining Cafe des Artistes you are voluntarily and expressly accepting these Terms and any changes or amendments we may do to them in the future. You are bound by this Terms.

This is an agreement between you and the Traffic Exchange business owner at the date of your Sign up.

1. Service and Benefits.

As a Cafe des Artistes Member you are entitled to use our services and enjoy benefits as published in the website, in our email communications or by any other official communication.  We may add or remove services and benefits in the future, and publish those changes by any those means.

2. Membership and other services fees.

2.1 Cafe des Artistes may offer different levels of paid Membership and other paid services.

2.2 To enjoy your full benefits of paid membership and services it is a requirement to be up to date with payments.

2.3 Current fees and payment conditions will be as published in the website and may change without previous notice.

2.4 The Traffic Exchange business owner, the person who actually manages this website and receives any and all payments, is the only responsible party for the offered services and goods.

3.   Commissions, earnings and profits.

3.1 You may earn a commission or profit on membership payments or any other payments made by your direct referrals, your downline, or in any other way that we offer. The rules for commissions will be published in the website.

3.2 You may earn cash for activity (for instance, cash surfing). It is understood that "cash" may be actual money or virtual money convertible to services. The rules for this concept will be published in the website.

3.3 Please make sure that you comply with the rules for commissions, earnings and profits.  You do not qualify for commissions if these requisites are not fully covered. We are not liable for commissions lost due to your failure to comply.

3.4 There is not any guarantee of earnings, either express or implied.  Your earnings will be a product of your own effort and talent.  We only provide for the tools and resources we consider appropriate for that purpose.  There is no money back guarantee of any kind.  Any fee paid to Cafe des Artistes will not be refunded.

3.5 With the exception of cash offered for activity (of instance, cash surfing), we only pay commissions, profits or earnings on actual payments received. Commissions, earnings and profits are a fraction of real income.

3.5 Commissions, profits and earnings will be paid when reaching a minimum pay out amount or converted to service according to the corresponding rules.

4. Membership suspension and cancel.

4.1 You may cancel your membership at any time.

4.2 When you cancel your membership you are voluntarily and expressly waiving any benefits or rights you may have with us.  This includes but is not limited to the usage of the website and tools, your downline, your position in the structure, services, any commissions, earnings or profits, present or future, you may have.

4.3 When you cancel your account we are not liable in any way.  We no longer have any obligations with you.

4.4 Canceling your pay processor subscription does not mean you cancel your membership.  To cancel your membership you must send a written request or notice to the administrator or business owner. You may cancel your membership from your Member's Area and this act will be considered written notice.

4.5 Canceling your membership does not mean that any pay processor subscription is canceled.  It is your sole responsibility to cancel your pay processor subscription.  If the pay processor bills you and we get paid we will not refund.

5. General considerations.

5.1 You are not allowed to promote or rotate any Adult, violence, offending or otherwise unethical, illegal or immoral websites.  We are not to be held responsible of any contents shown using our tools.  We can and will remove any website that we consider inappropriate at our sole discretion without previous notice.

5.2 You are not allowed to copy or otherwise make an unethical or bad usage of our website.  You can not show it from any other URL except those we have specifically designed and setup for that purpose.  You are allowed to use our website and pages with your referral id as indicated in the site itself.

5.3 This is a good faith private agreement.  By signing up and using our service you agree to our Terms and agree to leave us safe from any responsibility other than the explicit obligations we have acquired by the present document.

5.4 You agree to any changes or amendments we may do to this Terms in the future without the need of previous notice.  If you do not agree to any of the present Terms or their amendments you should cancel your account and stop using the service.

5.5 We have no obligation to any third party other than providing and managing the service and paying the commissions, earnings and profits according to this Terms and the rules we publish in the website.  We are not liable for any downtime in the service. 

5.6 We are not liable for any misuse that you or anyone may do of the website.

5.7 We can, at our sole discretion, terminate or eliminate any account at any time and for any reason.
